Anti-dumping Investigation by China against Resorcinol from Japan and US

The Ministry of Commerce of the People’s Republic of China received on February 3, 2012 the application for anti-dumping investigation formally presented by Zhejiang Hongsheng Chemical Co., Ltd. on behalf of domestic resorcinol industry. The applicants requested an investigation of anti-dumping against resorcinol imports from Japan and the U.S.

In accordance with the Regulations on Anti-dumping of the People’s Republic of China, the Ministry of Commerce reviewed the qualifications of the applicants, the subject product, like products in China, impact on the domestic industry of the product and the country involved. The Ministry of Commerce reviewed the evidence provided by the application involving dumping, injury and the causal link between dumping and injury. Primary evidence provided by the applicants suggests that the aggregate resorcinol output of the applicants, Zhejiang Hongsheng Chemical Co., Ltd. took up more than 50% of the total output of like products in the Chinese mainland in 2010 and January to September 2011, which accords with Article 11, Article 13 and Article 17 of the Regulations on Anti-dumping of the People’s Republic of China on the application for anti-dumping investigation by domestic industry. Meanwhile, the application includes the contents and related evidence required for anti-dumping investigation by Article 14 and Article 15 of the Regulations on Anti-dumping of the People’s Republic of China.

According to the outcome of the review and Article 16 of the Regulations on Anti-dumping of the People’s Republic of China, the Ministry of Commerce decided on March 23, 2012 to initiate an anti-dumping investigation against resorcinol imports from Japan and the U.S., and announced the following:

I.        Case-filing and the investigation period

Upon the release of this announcement, the Ministry of Commerce initiates an anti-dumping investigation against resorcinol imports from Japan and the U.S. The investigation period of this anti-dumping investigation is from October 1st, 2010 to September 30, 2011, and the investigation period of industry injury investigation is from January 1st, 2009 to September 30, 2011.

II.      Investigated product and investigation scope

Scope of Investigation: Resorcinol imports from Japan and the U.S.

Name of the investigated product: M-dihydroxybenzene or Resorcinol.

The tariff line of the investigated product is 29072100 according to the Customs Import and Export Tariff of the People’s Republic of China. and resorcinol salt is not subject to the investigation.

III.    Registration for responding

The interested party for responding to the anti-dumping investigation shall, within 20 days after the promulgation of this announcement, register with the Bureau of Fair Trade for Imports and Exports, Ministry of Commerce, and the responding exporters or manufacturers shall also supply to the Ministry of Commerce the volume and value of the investigated product exported to China between October 1st, 2010 and September 30, 2011. The interested party for responding to the industry injury investigation shall, within 20 days after the promulgation of this announcement, register with the Bureau of Industry Injury Investigation, Ministry of Commerce, and shall supply to the Ministry of Commerce production capacity, output, inventory, plans for expansion and construction and the volume and value of the investigated products exported to China. IV.     Failure to register for responding

If any interested party fails to register for responding to the investigation within the time limit, the Ministry of Commerce shall have the right to reject relevant materials submitted by the party, and make a decision based on available existing materials.

V.       Rights of the interested parties

If any interested party has objections regarding the scope of this investigated product, qualifications of the applicants, investigated country and other related issues, they can submit written comments to the Ministry of Commerce within the registration period.

VI.     Method of investigation

Investigation authorities can adopt the methods of questionnaire, sampling, hearing or on-site verification to obtain information form interested parties to proceed with the investigation.

VII.   The investigation shall be started on March 23, 2012, and completed by March 23, 2013. It may be extended to September 23, 2013 under special circumstances.
